Purpose of Data Processing and Legal Basis

The processing of personal data is necessary for:

  • the full and proper execution of the contract
  • the sale of products and/or provision of services in the relevant sector
  • fulfilling obligations in the tax and accounting fields
  • complying with obligations imposed on the company by current legislation (by way of example and not limited to: anti-money laundering, insurance, workplace safety)
  • defending a right in court or before judicial authorities exercising jurisdictional functions

Data processing is necessary to regulate:

  • the contractual relationship pursuant to Article 6(1)(b) of the GDPR
  • compliance with a legal obligation pursuant to Article 6(1)(c) of the GDPR

Methods of Processing

Data is processed using IT systems and/or paper-based means by duly authorized personnel bound by confidentiality obligations. Processing is carried out in accordance with the purposes indicated and in a manner that ensures the security and protection of the data.

Data Retention Period

Personal data processed for the purposes mentioned above will be retained for 10 years from the termination of the relationship, both in accordance with tax legislation and as evidence of the proper and timely execution of the service subject to the contractual relationship established between the parties.
If a dispute arises, data will be retained for the time necessary to exercise the right of defense and to manage the legal dispute before the competent judicial authorities.
Data processed based on consent will be processed until such consent is withdrawn or modified.

Scope of Communication and Disclosure – Possible Transfers

Personal data is processed within the offices of Explorer Agency & Services S.p.A. by personnel authorized to carry out the relevant functions.
Personal data may be disclosed to, or become known by, the following parties for the purposes outlined above and to provide, improve, protect, and promote the company’s services:

  • properly appointed external data processors, such as (but not limited to): accountants, consultants, IT service providers, cloud computing service providers or their support staff, collaborators
  • judicial or administrative authorities, in order to fulfill legal obligations or perform assigned tasks
  • banks and insurance institutions

Your personal data will not be disseminated, will not be transferred abroad, and will not be subject to automated decision-making or profiling.

Data Subject’s Rights

Pursuant to Articles 15, 16, 17, 18, 19, and 21 of the GDPR, the data subject has the right to request the following from the Data Controller:

  • access to their personal data and to all information referred to in Article 15 of the GDPR
  • rectification of inaccurate personal data and completion of incomplete data
  • erasure of their personal data, except for data included in records that must be retained by law or where a legitimate overriding reason for processing exists
  • restriction of processing where one of the cases under Article 18 of the GDPR applies
  • objection to the processing of personal data, subject to the necessity and lawfulness of processing for establishing the contractual relationship
  • withdrawal of consent previously given for non-mandatory data processing, without affecting the lawfulness of processing based on consent prior to withdrawal

Furthermore, the data subject has the right to lodge a complaint with the Supervisory Authority for Personal Data Protection pursuant to Article 77 of the GDPR.

To exercise any of the above rights, the data subject may submit a simple, reasoned request containing the essential elements required for its processing, as soon as possible and in any case within 30 days, to the following email address: amministrazione@explorer-as.it
